Ship investments may be made in two ways, either by a direct participation through acquisition of shares of one or several German “GmbH & Co. KG” each of which acts as holding company of a specific ship or indirectly through acquisition of participations in an actively managed certificate (AMC) the underlying of which are several ships. The taxation of a direct ship participation is carried out in Germany in accordance with the requirements of the German Income Tax Act (Art. 5), whereby the profit determination method of tonnage tax is applied.
